COMPLAINTS PROCEDURE (REKLAMAČNÍ ŘÁD) — Myble (my-ble.eu)

1. Scope
1.1. This Complaints Procedure governs the exercise of rights from defective performance (“complaints”) for Goods bought from the Seller (Bartłomiej Karol Kwaśnica, IČO 24439673) via my-ble.eu, and complies with the Czech Civil Code and the Consumer Protection Act. 1.2. For consumers, nothing in this Procedure limits mandatory statutory rights.
2. The Seller’s liability for defects
2.1. The Seller is liable that the Goods are free of defects on receipt and conform to the contract (quantity, dimensions ordered, quality, purpose). 2.2. A consumer may exercise rights from defective performance for defects that appear within 24 months of receipt. 2.3. Liability does not cover: normal wear and tear; defects caused by incorrect assembly contrary to the instructions; improper use, overloading, or storage in unsuitable conditions (e.g. excessive humidity, direct heat); or damage caused by the consumer after receipt.
3. Manufacturing tolerances
3.1. Dimensional deviations within normal manufacturing tolerances (typically millimetre level) and reasonable variations in décor/shade are not defects.
4. How to file a complaint
4.1. Submit the complaint without undue delay after discovering the defect to myble.eu@gmail.com, including: - order number, - description of the defect (and how it appears), - photo/video documentation, - preferred remedy (if any). 4.2. For visible transport damage, document it on receipt (photos of packaging and Goods) and notify the Seller without undue delay. 4.3. The Seller confirms receipt of the complaint and the date it was filed.
5. Remedies
5.1. Depending on the nature of the defect and statutory rules, the consumer may be entitled to: repair, replacement (of the Goods or a part), a reasonable discount, or withdrawal from the contract where the defect is material or repair/replacement is not possible/timely. 5.2. The Seller may supply replacement parts (e.g. a single panel or fitting) where this remedies the defect.
6. Handling time
6.1. The Seller will decide on the complaint without undue delay (in complex cases within 3 working days), and will handle the complaint, including any repair, within 30 days of the date it was filed, unless a longer period is agreed with the consumer. 6.2. If the 30-day period is exceeded without agreement, the consumer has the rights that arise from a material breach of contract. 6.3. The Seller issues the consumer a written confirmation of when the complaint was filed, its content, the requested remedy, and subsequently of the date and manner of resolution.
7. Costs
7.1. Where a complaint is justified, the consumer is entitled to reimbursement of the reasonable costs incurred in exercising the right (e.g. return postage).
8. Out-of-court dispute resolution
8.1. A consumer may turn to the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), coi.gov.cz, for out-of-court resolution of a consumer dispute.
